To the editor: 

As for the “right of way” road problem between Fales Ave. and Chachapacasset, there should never have been any problem or question at all.  

According to the “adverse possession law” that the town has, it seems to state that if one property owner exceeds their property line over another property line and there is no objection for a statutorily prescribed number of years, that land is no longer in question of ownership. This road has been a road for over 50 years. It seems that should be enough time to validate its legal existence.

Perhaps the complaining party who objects to paying taxes on the land that the road takes up should have whoever checked the deed in the first place, check it with the town of Barrington. And as for the complaining party’s fear of someone coming to harm when using the road and possibly being sued, that would not happen because the road does not belong to that property owner. If anything, someone might get hurt trying to get past that ridiculous fence that was put up to stop anyone from using it.                                                                

None of us in the community has ever been injured when using the right of way to travel from one road to the other. Good neighbors don’t do this kind of thing, and ours is quite a wonderful neighborhood. We would like to keep it that way. I hope that this kind of problem is not what comes with a new generation of property owners.
