Man guilty of assaulting children at Portsmouth polo match

Held without bail until May 17 sentencing

PORTSMOUTH — A man charged with inappropriately touching two 10-year-olds at Glen Farm in 2014 was found not guilty Monday of second-degree child molestation in Second District Court in Newport.

However, Brian Smith, of Saunderstown, was found guilty of two counts of simple assault on a child. At the request of the Attorney General’s Office, he was also ordered held without bail until his sentencing next month.

He had been out on bail at the time of the verdict, which came after a trial that began March 28.

Mr. Smith, who was 52 at the time of his arrest in July 2014, is facing a maximum sentence of two years — one year for each count of simple assault, according to the state Attorney General’s Office. Sentencing is slated for May 17.

On July 19, 2014, Portsmouth police responded to the Gardner Seveney Complex on East Main Road for a report that two 10-year-olds had been touched inappropriately while attending the polo event. Police said a Bryant University alumni polo match was being played at the Newport International Polo grounds at the time.

Police alleged that Mr. Smith engaged the children in a conversation and inappropriately touched them, including underneath one of the child’s skirt.

In a separate case that’s still pending, Mr. Smith is charged with one count of second-degree child molestation in Smithfield, according to the Attorney General’s Office.
