The Warren Town Council as part of its meeting agenda Tuesday evening, Jan. 14, took up an item pertaining to a potential lawsuit being brought by parties alleged to have been injured in a motor vehicle accident involving a police officer in late November of last year.
Three people — Michael Fleming, Elyse Monteiro, Maia Monteiro — through their attorney, the Bottaro Law Firm LLC located in Providence, have initiated a claim against the town, seeking unspecified damages.
Mike R. Bottaro, Esq., wrote in a notification to Town Clerk Sandy Speroni and Deputy Clerk Jessica Capaldi, "This is a claim for personal injuries arising out of a motor vehicle accident. A Warren Police Department vehicle crashed into our client's passenger side fender and front/rear door...The known injuries at this point include whiplash (head, neck)."
Specifically, the accident occurred at 651 Metacom Ave. The submission by Bottary referred to the requirement in R.I. Gen. Laws § 45-15-9 and 45-15-10, Notice of Injury.
Town Solicitor Anthony DeSisto recommended the council reject the claim and send it the town's insurer, the Rhode Island Interlocal Risk Management Trust.
During the brief discussion of the topic Tuesday night, DeSisto told the council, "There is no monetary amount affixed to this because it's in the preliminary stages. You need to deny the claim and refer it to the trust so that they can handle this going forward."
Outside of the meeting setting, DeSisto said of the assertions in the filing, "That's their story. An adjuster will be assigned to the case and they will do the investigation...This is going to be handled like any other automobile accident. The trust will make a determination if the town is liable. They do a very good, by the way."
According to the Warren Police log for that week, the event took place on Sunday, Nov. 24, 2024, at approximately 5:25 p.m. in the area of Metacom Avenue and Ridgeway Drive.
At the time of the "officer involved" accident, air bags did deploy and fire department personnel were dispatched to the site. The report stated "two patients" were evaluated and later transported to hospital. WPD investigators were also on scene to conduct an accident reconstruction. The report concluded with both vehicles being towed from the location.
