A Warren man was arrested at an apartment complex on Metacom Avenue on Sunday, Jan. 22 after an incident where he allegedly brandished a shotgun while intoxicated during an incident that occurred with his neighbors.

According to the arrest report provided by the Warren Police Department, Franklin Larrivee, 53, was arrested and charged with disorderly conduct, possession of a prohibited large capacity feeding device for a firearm, and carrying a weapon while under the influence of liquor or drugs.

The incident began around 9:38 p.m., when officers were called to the apartment complex for a report of a man brandishing a shotgun.

According to the report, Larrivee had allegedly answered his door following repeated knocking by some of his neighbors inquiring about loud noises coming from his apartment. According to one witness interviewed, Larrivee allegedly answered the door holding a shotgun, saying, “Is there a [expletive] problem?” Larrivee, when talking to police, said that he never pointed the gun at anyone.

Upon arriving at the scene, officers instructed the other tenants away from the apartments to safety while they attempted to contact Larrivee and get him to emerge from the apartment with his hands raised.

Per the report, police “instructed the resident of the apartment to step outside with his hands in the air. [Another officer] provided these orders twice, both times yielding negative results. [Officers] then heard the sound of the male party working the action of the pump action shotgun, signifying that a round was being loaded into the chamber of the shotgun. [Another officer] then ordered the male party to exit the residence three times. The door slowly opened and [an officer] ordered the male party to exit the apartment with his hands on top of his head, kneel down, and cross his legs. It should be noted that officers had the resident at gun point when giving the male party instructions. The male party did not immediately comply with officer's commands. [An officer] instructed the male party to then walk slowly away from his apartment, and in front of the stairwell. [Officers] then walked up the stairs and secured the male party in hand restraints that were double locked and checked for proper fit.”

After securing the suspect, police noticed the smell of alcohol on Larrivee’s breath when questioning him, and found multiple types of alcohol in the apartment.

Upon a thorough search of the apartment, police found and seized the following items:

• (3) Kel-Tec P17 12 Round Magazines.

• (100) Blazer 9mm Rounds of Ammunition.
• (150) Magtech 9mm Rounds of Ammunition.
• (300) Olympic 9mm Rounds of Ammunition.
• (435) Norma-USA Tac 22 Rounds of Ammunition.
• (800) Federal 22mm Rounds of Ammunition.

Larrivee was transported to headquarters where he was processed, and was transported to district court the following morning, where he was turned over to the Sheriff’s Department.
